These Terms & Conditions (“Terms”) govern your use of the Schoolkuz website and services.
Schoolkuz is operated by Evgeny Kuznetsov (“Schoolkuz”, “we”, “us” or “our”).

By creating an account, you confirm that you have read and agree to these Terms. You must also acknowledge our Privacy Policy during registration.
Schoolkuz is a free platform that helps people in school communities find and contact each other for:
Schoolkuz does not sell the items, provide the tutoring, collect payments, arrange delivery or become a party to agreements between users.

Schoolkuz is an online platform that allows users to publish listings for school-related and extracurricular items, create Tutor Profiles, search for items and tutors, communicate with other users and request access to another user's contact details.
Schoolkuz acts only as an intermediary that helps users find and communicate with each other.
Schoolkuz is not:
Any agreement concerning an item, tutoring or another permitted service is made directly between the relevant users.
Schoolkuz is currently free to use.

We may introduce additional or paid features in the future. If this materially changes the relationship between Schoolkuz and its users, these Terms will be updated and users will be informed as described in Section 23.
You must be 14 years old or older to create a Schoolkuz account.
Users under the age of 14 may not register or use an account.
Users aged 14 or 15 may use Schoolkuz features including:
However, users under the age of 16 may not create a Tutor Profile or offer tutoring through Schoolkuz.
Only users aged 16 or over may create a Tutor Profile and offer tutoring.
Eligibility to create or maintain a Tutor Profile is determined using the date of birth provided in the user's Schoolkuz account.
Users must provide their correct date of birth and must not provide a false date of birth in order to gain access to age-restricted features.
Users aged 16 or 17 may offer tutoring through Schoolkuz. However, where applicable law requires the consent, assistance or involvement of a parent or legal guardian for a particular tutoring arrangement, transaction or other agreement, the user is responsible for obtaining it.
Being permitted to use a Schoolkuz feature does not necessarily mean that a minor may independently enter into every possible legal agreement.
To use certain Schoolkuz features, you must create an account.
You must provide accurate information during registration and keep your account information reasonably up to date.
Schoolkuz currently verifies the user's email address through an email verification link.
Schoolkuz also uses the date of birth provided by the user to determine eligibility for age-restricted features, including the ability to create a Tutor Profile.
Schoolkuz does not independently verify the user's date of birth or identity unless expressly stated otherwise.
Email verification only confirms access to the relevant email account. It does not mean that Schoolkuz has independently verified:
You are responsible for keeping your password secure and for activity carried out through your account.
You must not knowingly allow another person to use your account in a way that violates these Terms.
Schoolkuz is currently intended for private individuals, not businesses or professional commercial sellers.
Users must not use Schoolkuz to operate a shop, commercial resale business, tutoring company, academy or similar professional business activity.
Private individuals may sell their own items and may offer tutoring through a Tutor Profile.
Whether a person is legally considered a consumer, trader, professional or business may depend on the actual circumstances and applicable law, rather than only on how that person describes themselves.
Schoolkuz does not independently verify each user's legal status.
Transactions between private individuals normally do not have the same consumer-protection rules that apply when a consumer purchases from a business or professional trader.
Users may create listings for permitted items.
The person publishing a listing is responsible for ensuring that:
The condition selected for an item, such as “New”, “Like new”, “Good” or “Fair”, is provided by the user.
Schoolkuz does not inspect or independently assess listed items.
Schoolkuz may be used to offer legitimate educational materials, including, where lawful:
The general rules of these Terms continue to apply.
For example, users may not sell material that is stolen, unlawfully obtained, counterfeit or offered in violation of another person's intellectual-property rights.
Schoolkuz does not determine whether particular academic material may be used in accordance with the rules of a user's school, examination body or other educational institution. Users are responsible for complying with any such rules that apply to them.
Users must not offer, publish, request or distribute through Schoolkuz anything that is illegal or prohibited by these Terms.
This includes, without limitation:
Schoolkuz may remove a listing or other content where we reasonably believe it falls within one of these categories.
Only users aged 16 or over may create a Tutor Profile and offer tutoring through Schoolkuz.
Users creating or maintaining a Tutor Profile are responsible for ensuring that the information they provide is truthful, accurate and not misleading.
When creating or updating a Tutor Profile, the user may optionally confirm that:
Schoolkuz does not routinely require users to upload supporting evidence when creating a Tutor Profile.
However, Schoolkuz may request reasonable supporting evidence where necessary, for example in connection with a report, suspected inaccurate information, a safety concern or moderation of the platform.
Failure to provide requested evidence does not automatically mean that the information is false. However, Schoolkuz may restrict or remove information or a Tutor Profile where there are reasonable grounds to believe that information is false, misleading or cannot reasonably be substantiated.
Schoolkuz does not independently verify or guarantee:
Schoolkuz does not supervise or control tutoring sessions and does not guarantee any academic or other result.
Before arranging tutoring, users — and parents or guardians where appropriate — should make their own assessment of the tutor and the proposed arrangement.
Any tutoring arrangement, including the price, location, schedule, method of teaching and payment, is agreed directly between the users.
Schoolkuz is not the employer, representative or agent of a tutor.
Schoolkuz uses a Contact Request system to control when users exchange personal contact details.
Users must not publish or exchange contact information before the relevant Contact Request has been accepted.
This restriction applies to information including:
Users must not place such information in:
Users must not attempt to disguise contact information or otherwise bypass the Contact Request system.
Once a Contact Request has been accepted and Schoolkuz makes the permitted contact details available, the users may communicate directly with each other.
After users connect, they are responsible for agreeing directly on matters such as:
Schoolkuz does not currently handle or hold payments.
Schoolkuz does not arrange shipping, delivery or collection.
Schoolkuz does not guarantee that a user will proceed with a transaction after expressing interest or accepting a Contact Request.
Users should take reasonable precautions when dealing with people they meet through Schoolkuz.
Before purchasing an item, users should assess the item themselves and make sure that they are satisfied with its identity, condition and suitability.
Users should be cautious before sending money to someone they do not know.
Where users meet in person, they should choose an appropriate and safe arrangement.
A user under the age of 18 should not arrange or attend an in-person meeting with another Schoolkuz user without the knowledge and appropriate permission or supervision of a parent or legal guardian.
Parents and legal guardians are encouraged to be involved in transactions and tutoring arrangements involving minors where appropriate.
Users must treat other users appropriately.
You must not use Schoolkuz to:
“User Content” means information or material that users submit to Schoolkuz, including:
You remain responsible for your User Content.
You must have the necessary rights to publish it.
By submitting User Content, you give Schoolkuz a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content only as reasonably necessary to operate, provide, secure and moderate Schoolkuz.
This licence does not transfer ownership of your content to Schoolkuz.
Where content is removed or an account is deleted, Schoolkuz may retain limited information where permitted or required under the Privacy Policy or applicable law.
Users may search and filter marketplace listings using available criteria, including categories, subcategories, school, condition and price.
The default sorting option is Relevance.
Where a user enters a search query, Relevance is based primarily on how closely listings correspond to the user's search.
Users may also select:
Schoolkuz does not currently sell paid search ranking, and users cannot pay to make a listing rank higher in the marketplace search results.
Users may identify schools in listings or profiles where the platform provides this functionality.
References to a school are intended to help users find relevant items, tutors or other users.
Unless Schoolkuz expressly states otherwise:
Schoolkuz is an independent platform and is not affiliated with, endorsed by, sponsored by or operated by any school shown or referred to on the platform.
School names, logos and other identifiers may belong to their respective owners.
A user's reference to a school does not mean that Schoolkuz has verified that user's relationship with that school.
Schoolkuz does not currently review every listing, Tutor Profile or message before publication.
There is currently no automated system that decides whether user content should be removed or whether an account should be suspended.
Moderation is carried out manually.
Schoolkuz may review content or an account when, for example:
Depending on the circumstances, Schoolkuz may take measures including:
The measure taken will depend on factors including the seriousness and nature of the issue, its potential effect on other users, whether the conduct is repeated and any relevant legal obligations.
For serious matters — including suspected fraud, illegal content or circumstances presenting a significant safety risk — Schoolkuz may restrict or remove content or accounts without first issuing a warning where appropriate.
Schoolkuz will seek to apply its rules in a diligent, objective and proportionate manner.
A person who believes that specific content on Schoolkuz is illegal may report it electronically to:
The report should provide enough information for Schoolkuz to identify and assess the content.

Schoolkuz will assess reports concerning allegedly illegal content in accordance with applicable law, including the Digital Services Act where applicable.
If you believe that your content or account was restricted or removed by mistake, you may contact:
Please provide enough information for us to identify the relevant account, content and decision and explain why you believe the decision should be reconsidered.
Schoolkuz will review the information provided and may uphold, modify or reverse its decision where appropriate.
Schoolkuz does not inspect items listed on the platform.
Schoolkuz therefore does not guarantee:
Likewise, Schoolkuz does not guarantee the qualifications, suitability, reliability or performance of tutors.
Users are responsible for making their own decisions before purchasing an item, providing an item, engaging a tutor or entering into another arrangement.
Users should first attempt to resolve disagreements concerning items, tutoring, payment, collection or other arrangements directly with the other user.
Schoolkuz is not a party to these agreements and is not required to determine contractual disputes between users.
However, users may contact Schoolkuz where conduct may violate these Terms, involve suspected fraud, present a safety concern or involve potentially illegal content.
Schoolkuz may take action concerning use of its platform but does not thereby assume responsibility for resolving the underlying transaction or paying compensation to either user.
A user may request deletion of their account through:

Once the deletion process begins, the account, listings and Tutor Profile are made unavailable.
Chats involving the deleted account may no longer identify or provide access to that user and may display the account as a deleted user.
A 14-day deletion period applies.
After that period, personal data is deleted or retained only where and for as long as permitted or required under the Privacy Policy and applicable law.

Schoolkuz may update these Terms where reasonably necessary, for example because of:
The current version will be published on the Schoolkuz website with its updated date.
Where a change is significant, Schoolkuz will also inform registered users by email.
Continued use of Schoolkuz after updated Terms become applicable constitutes acceptance of the updated Terms where permitted by law.
If a change requires separate consent under applicable law, Schoolkuz will request that consent.
Schoolkuz may change, improve, discontinue or temporarily suspend features where reasonably necessary.
We do not guarantee that Schoolkuz will always be available without interruption, delay, errors or technical problems.
Where reasonably possible, Schoolkuz will seek to avoid unnecessary disruption.
Nothing in this section affects any rights that cannot legally be excluded or restricted.
Except for User Content and third-party materials, the Schoolkuz website and its original content, branding, design, software and other materials may be protected by intellectual-property rights.
Users may use Schoolkuz for its intended purposes.
Users may not copy, reproduce, commercially exploit, reverse engineer or misuse protected Schoolkuz materials except where permitted by law or with permission.
Schoolkuz processes personal data as described in its Privacy Policy.
The Privacy Policy explains, among other matters:
The Privacy Policy forms an important part of understanding how Schoolkuz operates but is separate from these Terms.
Schoolkuz is responsible for its own obligations under applicable law.
However, because Schoolkuz acts as an intermediary between users, Schoolkuz is not responsible merely because a user:
To the extent permitted by law, Schoolkuz is not responsible for indirect or unforeseeable losses arising solely from agreements or interactions between users.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any liability or rights that cannot be excluded under applicable consumer or other mandatory law.
Users may stop using Schoolkuz at any time.
Schoolkuz may restrict, suspend or terminate access where reasonably necessary because of:
Where appropriate and legally required, Schoolkuz will provide information about the reason for a restriction or decision.
A user who believes a decision was made incorrectly may contact contact@schoolkuz.com as described in Section 19.
These Terms are governed by Spanish law.
Any dispute relating to these Terms or Schoolkuz will be subject to the courts having jurisdiction under applicable law.
Nothing in these Terms removes, restricts or replaces any mandatory rights or protections that apply to a user under applicable law.
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure by Schoolkuz to enforce a provision immediately does not necessarily mean that Schoolkuz has waived its right to enforce it later.
These Terms, together with documents expressly referred to in them where relevant, govern the user's use of Schoolkuz.
